These Terms of Service (“Terms”) govern your access to and use of the smallFactory service (the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Eligibility

You must be at least 18 years old (or the legal age of majority in your jurisdiction), have the legal authority to enter into these Terms, and use the Service only in compliance with applicable laws. We may refuse access to anyone at any time, for any reason.

2. Accounts

You are responsible for maintaining the confidentiality of your account and password, and for all activities that occur under your account. You must notify us immediately if you suspect unauthorized use. We are not liable for any loss or damage arising from your failure to safeguard your account.

3. Acceptable Use

You agree not to use the Service for unlawful purposes, upload malicious code, attempt to reverse engineer our systems, or infringe on intellectual property rights. Violation may result in suspension or termination of your account.

4. Data and Content

You retain ownership of all content you upload or create (“User Content”). You grant us a limited license to host, store, and process your User Content solely to provide the Service. We do not monitor User Content but reserve the right to remove content that violates these Terms.

5. Payment & Subscriptions

Fees are charged according to the plan you select. Payments are processed by third-party providers, and all payments are non-refundable unless required by law. We may change pricing with prior notice.

6. Service Availability

The Service is provided on an “as is” and “as available” basis. We do not guarantee uptime, availability, or that the Service will be error-free. We may modify, suspend, or discontinue features at any time without liability.

7. Disclaimer of Warranties

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Any reliance on the Service is at your own risk.

8. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months preceding the claim (or $100 if no payment was made).

9. Indemnification

You agree to indemnify, defend, and hold harmless smallFactory and its affiliates from any claims, damages, or expenses arising out of your use of the Service, your violation of these Terms, or your infringement of third-party rights.

10. Termination

We may suspend or terminate your account at any time, with or without cause or notice. Upon termination, your right to use the Service ceases immediately. You may stop using the Service at any time.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. You agree to submit to the exclusive jurisdiction of courts located in Alameda County, California.

12. General Provisions

If any provision of these Terms is found invalid, the remaining provisions remain in effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and smallFactory.
